Vote for Dan Deppen - Reasons Why?

This will be the most consequential election Viewpointe has had in the past ten years; (a) there has NOT been a fair and legal in that time frame (b) several attempts have been made to modify an alleged 'bylaws' document, that has been surrounded by fraud and deception (c) several board members have been allowed to stay on the board for many years - circumventing the democratic process (d) our water system is failing for many years, but no major progress has been made to repair it - instead a dream of applying for a grant keeps us in limbo with perpetual repair costs accumulating (e) our community is in need of maintenance, but there is no plan to catch up - meanwhile, our community in in obvious disrepair. This has an impact on property values.

Dan Deppen believes it is time for change. And he knows how to make the necessary changes to make Viewpointe the best it can be. Here are his Goals for Viewpointe:

Get elected to the Viewpoionte as a board member.
Report to the members with transparency what is happening and take polls to hear what the members want to happen.
Make a plan to repair the water system to include a backup plan.
Draft a new set of Bylaws to include the necessary verbiage/legal clauses to protect the members best interests; especially fair elections.
Catch up on maintenance and repairs.
Hold regular member meetings in person and online.
Come up with a plan to hold member meeting at Viewpointe vs driving to the management company office.
Treat all members with respect and give them an chance to voice their opinions and viewpoints.
Make a policy that is fair to any member who falls behind or can't can not pay their dues that is equitable to the association and to end the unfair collection policy currently in place that attacks members with high attorney costs that prevent recovery. Everyone has a obligation to pay their dues, but there is a fair and mutually equitable method to accomplish this.

Note: There is a chance that a ballot measure to vote for a Bylaws Amendment could make its way to the 2025 Election. There has been no news of that happening, but IF it does, please vote NO; the proposed draft is BAD for Viewpointe.

Have our Elections been fair?

No, the Elections have not been fair. The history of Viewpointe and it's Elections have been fraught with mistakes, omissions and manipulation from the management company, our corporate attorney and power hungry board members. *See letter from Attorney Daniel G. Barker.

What happened at the February 8, 2024 Election?

Quorum was not met. Financial reports were given and the meeting was opened up for Q & A.
Dan Deppen made four (4) objections to the 2024 election:
1) Holdover board members did not meet the one (1) year prerequisite in section 4.02 of the alleged bylaws paragraph 3.
2) Section 4.02 paragraph 3 of the alleged bylaws state the current board members may decide which two (2) board members, who meet the one (1) year prerequisite may holdover. There are three (3) holdovers, which is a violation of the section.
3) Mr. Deppen claimed he did not receive a nomination packet. He further explained that things happen and maybe for some reason the mail was not delivered. However, this may not be an coincidence, since this happened in 2017 and 2019, and now again in 2024.
4) Dan Deppen delcared the 2024 election "null and void on its face" and requested the election be done over.
Dan Deppen requested that his objections be added to the minutes of the meeting.

What happend at the February 15, 2024 - 2nd Annual Meeting (reduced quorum)?

Meeting was opened and and since the quorum was reduced for the 2nd meeting, quorum was attained.
Total ballots was reported as 57 in number. A low turn out.
There was a declared two (2) open seats and a declared three (3) holdover seats, which goes against the rules in the alleged bylaws, section 4.02.
Dan Deppen submitted a written statement declaring the 2024 election "null and void on its face" and a request to do the election over again and to following the rules of law. His objections and request was added to the Corporate Minutes. THE BOARD DID NOT READ THE STATEMENT OR COMMENT ON ITS CONTENTS OR OFFER TO REDO THE ELECTION. IT WAS IGNORED.
The board went to executive meeting to select the officers of the association.
The meeting was adjourned.

The pending 2024 Election has been manipulated; for the 3rd time Dan Deppen has been unfairly kept off the ballot. It happened previously in 2016 and 2019. Candidate, Dan Deppen did not receive a nomination packet for 2024 and his hand typed nomination was rejected as being late?! This is obviously no accident. The 2024 election is hereby tainted. Additionally, write in candidates are not allowed this year. Only the members should determine who they want to vote for and not the management company, the election committee (if there is an election committee?), or power hungry board members. This is not a fair and democratic process. This kind of behavior is a bad precedent for Viewpointe, whether your wanted to vote for Dan or not.

Note: In 2020, then President, Dave Smethers and his wife went door-to-door slandering Dan Deppen's good reputation (who was a candidate) along with a notice to all members on the Viewpoite Website. This happened just before the ballots were sent out. The parties in control do not want Dan to be on the board, because he wants to audit Viewpointe's books and records.

2024 Election Violation of the "alleged" bylaws - Section 4.02 states that holdover board members are required to have held office in the previous year for the period of one (1) year; doing the math, the hold overs are 41 days short of that requirement. *Math: 2023 election date 3/21/23 vs 2024 election date 2/8/24 is 324 days - 365 days = 41 days short.

Observation supported by written admission - Early opening of ballots; Ms. Trost, of Mission Management stated the 2023 ballots were opened by 12:00 pm, five (5) hours before the closing of the ballots, which also presupposes that there was not an election committee of the members. *Source: 2023 minutes, section H, questions and answers. This should never be allowed.

If the 2024 election is not cleaned up (redoing the election and adding Dan Deppen to the ballot), then is the new management company, Mission Management and/or the board members would be supporting a tainted and unfair election.

Whether you want to vote for Dan Deppen or not, this is about a fair and democratic election process. If you did want to vote for him, then you have been disenfranchised.
