Augusta Britt spent ~ $20,000 of her own money in an effort to legally force Viewpointe board members and the management company (Associa) to proffer books and records. Later, after she ran out of money, the board forced her to sign an NDA (nondisclosure statement) to get out of the lawsuit, so she could not talk about the case to any other member about the information she obtained. It is estimated the board spent roughly $20,000 in attorney fees, which was not recovered. Note: Under Arizona law; every member in an HOA has the right to books and records, without having to seek a court order to obtain them. The President of Viewpointe at the time was Larry Bodine and the attorney was Michael Shupe (our current corporate attorney).
